In view of your position on what you consider to be fundamentally bad with the proposed Constitution i.e. the Kadhis Courts and your fear of being "eaten up" by our "brothers" ( I am even glad you are calling them "brothers") under sharia, I wish to hear your comment on the paragraph 3 of the Preamble that states "We the People of Kenya - Proud of our ethnic, cultural and religious diversity, and determined to live in peace and unity as one indivisible nation".
Suppose the NO wins what plans do you have to address the needs, rights and aspirations of this segment of the people of Kenya that you rightly call brothers which I believe also includes sisters? Are you planning to ex-communicate these "brothers" from the face of Kenya? Are you planning to make Kenya a theocracy based on apostolic law?
In my humble view, what holds the future for a secure and united Kenya which a I believe is a shared desire by every Kenyan, is not religious, ethnic and cultural bigotry but our readiness to embrace and tolerate each other because as a nation we are already multicultural, multi-religious and multi-ethnic. That is the reality of our lives in Kenya and that is why the proposed Constitution is very clear on our pride as a diverse nation right from the beginning. To ensure tolerance in diversity, the Bill of Rights in Article 24 provides circumstances under which rights of each one of us are limited, be they civil, political, social, economic, communal or religious rights. For example, to ensure that you and others who share your fear are not "EATEN UP BY OUR BROTHERS UNDER SHARIA" Article 24 (4) states:
"The provisions of this Chapter on equality shall be qualified to the extent strictly necessary for the application of Muslim Law (Sharia) before the Kadhis' courts, to persons who profess the Muslim religion, in matters of personal status, marriage, divorce and inheritance" .
Very clearly, the proposed Constitution takes care of your fears and be rest assured that you will not be "EATEN UP BY OUR BROTHERS UNDER SHARIA" because one, you are not a Muslim and two, Muslim religion is only a source of Muslim law and Kadhis Court is not established as mosque where faith is propagated but a subordinate court to settle disputes of personal nature only among the Muslims.
I therefore believe that what you call BAD in the proposed Constitution will never be cured by your or Churches' prescription of social exclusion in a country of extreme diversity, whether the NO side wins or whether we postpone the referendum for another century. In life there are things you may not like but circumstances force you to accept and live with them. One such circumstance is having person of a different faith who you may not like living in your neighbourhood or having a husband or wife who snores enjoined to you permanently, for better or for worse, till death do you part etc.
I therefore implore you to COME BACK TO YOUR MINDS as you remember the following fundamental teachings of the Christian Faith;
a) The story of the good Samaritan (Luke 10: 30-37)
b) The Greatest Commandment (Mathew 22: 34-40)
c) Seven Woes (Mathew 23)
