THE SUPREMACY OF THE CONSTITUTION


Supremacy of this Constitution: Article 2(1)(2)

 

2. (1) This Constitution is the supreme law of the Republic and binds all persons and all State organs at both levels of government.

 

 (3) The validity or legality of this Constitution is not subject to challenge by or before any court or other State organ.


The above make ambiguity legally unchallengeable.And given the fact that it will be difficult, in fact almost an impossibility to amend the constitution, we are facing a situation where we shall argue and disagree forever on the content of the constitution.

I see legal battles being fought about the constitution persisting beyond the current regime. Ramming the draft through people's throat shouldn't be the way forward.
