Re: [NVK-Mageuzi] Mutula on ICC

Indeed the dilemma of a new dawn amidst marauding impunity! The contest between the old order and the emerging dispensation is both grueling and abrassive and will no doubt impact adversely on the reform agenda. I hasten to observe and affirm that it is time to proclaim liberty and rights and not to confuse, oppress and deny justice.
 
Although Hon.Mutulas' assertions are sound as they are informed by the need to give life to the new constitution and as well build confidence in the dispensation of justice especially by the new face judiciary, I still find immense value in the original thinking of a credible local tribunal alongside ICC so as to ensure complimentary and coordinated approach to the fight against impunity. These institutions will no doubt provide the requisite checks and balances as well cushion against competing political interests and related manipulations.  
 
I reiterate the need to maintain clarity and focus in tackling impunity and associated challenges. Indeed the pursuit for justice must remain objective, above board and beyond prejudices, nuances and without fear or favour. This is the only way to reclaim in honor and happiness what has been taken away, looted and even destroyed in shame, pain and grief.

The way I see it, this is only but another act in the well planned strategy to undermine/sabotage the ICC process. The first act was to host Bashir on a most historic occasion for the country, despite the baggage he carries. This, then, in my opinion, is a continuation of a well laid out plan. One can clearly see where this is all headed...

And as LSK and other people have pointed out, the mere act of enacting the constitution, or even appointing a new Director of Public Prosecution, does not and cannot suddenly give the Kenyan judicial system the competence and independence necessary to effectively prosecute the PEV cases - especially those cases presently being investigated by ICC. The judicial system in Kenya will take time to mature, the ongoing reform initiatives notwithstanding - as everyone including Mutula well understands.
