THE DIASPORA VOTING AND REPRESENTATION IN 2012 (Just pursue,its about legislation)


Dear all,

The question about the diaspora representation in legco could not have come at any other time most suitable.This is the real appropriate time.

Its not about the government being silent,its all about legislation.

You can appreciate the following;-

1.For along time,kenya has never been connected worldwide as it is now.Technological advancement and in particular the use of internet occasioned kenyas in the diaspora participation in a national project ( The constitution Review Process that a few years ago was a game of the civil society versus die hard status quo politicians ) in the streets, political forums,court rooms and jail.Parliament helped to rubber stamp political interests of the day.

2.Supreme law.The just promulgated constitutions provides for all Kenyans including those in foreign land.Implementation will take about five (5) years with further Acts of parliament being legislated.Its in the legislation that the diaspora community will find an entry window to any meaningful representation to the august house.

3.Away from court theatrics on constitutionalism,this is the time for you to seek court interpretation on the rights of representation as Kenyans and as contributors to the national kitty.

4.House in order.As brother Sungu has put it,you are the ones who feel the pinch at the ground ( wherever you are).On that strength,organisations like KCA,KGU ETC Can do memos to the various embassies and high commissions for onward transmission to the Ministry of Justice for the purpose of making bills to be debated in p

This is worth chasing, with an estimated Ksh 150 billion from diaspora annually, diaspora is propping the Kenyan economy big time and it is only prudent for the govt. of Kenya to begin involving them in form of representation and voting rights.
 
It is definitely ridiculuous that patriots who remit that kind of money back home do not even have a right to vote leave alone have representation of what affects them in their constituency. There are very many challenges diaspora face, some as serious as in cases akin to slavery like in some parts of the Middle East.
 
It is time these matters were raised consistently through a voice that will push the government to fomulate policies that ensure such challenges are mitigated.
 
Most of our Our High Commissions, Consulates and Embassies have been a big let down, they play political games and sing political tunes instead of serving Kenyan interests abroad, many have no idea how to deal with the problems of their compatriots. In Southern Sudan for instance, Kenyans have been a target by their hosts for nothing else than their aggressive business and professional acumen, the representatives have not done as much as their Ugandan conterparts who are on top of things regarding matters affecting Ugandans in Southern Sudan.Some have been defraudd of businesses by counterparts, killings in cold blood have been rampant and harrassment is everywhere, just because one is a Kenyan!!!!
 
It is time we got representation proper, the diaspora is a constituency too vital to ignore the way the Kenyan government is doing.

Dear All
As reported by standard newspapers today (http://www.standardmedia.co.ke/InsidePage.php?id=2000020677&cid=4&), the diaspora adult population has
grown tremendously and is currently remitting over $2 billion (Sh150 billion) annually.   This is an enormous contribution. While the case about the diaspora voting and representation has been made in court and out of court, there is no sign that the government is doing something about it. The worst part of it is that the very same government will come back and tell us that there is no logistics in place to do this.
 
I am perplexed that this issue is not even in the agenda of the constitution implementing committee and yet it almost derailed the voting during the constitution referendum. The diaspora are tired of being taken for granted. It is time the government start putting logictics in place to enable diaspora voting. Moreso the diaspora is now a constituency and should be represented just like other countries have done. One cannot ignore over 3 million people. We have problems just like other people at home and since we are paying more, our government should also help us during our times of need. 
This is an issue that the government should address now. It is just fair that our issue be discussed in parliarment and be included in the implementation lagislation.

So what do we do? Should we, therefore, plead with Kibaki on behalf of Kenyans, to purdon all those who have been implicated in Corruption cases? 'Cause it looks like what you are saying is that, since this Ruto's case have been brought to court, he should not be prosecuted. In any case if Ruto is innocent, as he claims to be, what then will he be afraid of? His lawyer or himself will present evidence in Court to show why he is innocent. The Judges, if they find that the evidence is not good enough to show that Ruto is guilty, will have no alternative but to acquit him.
 
Right at the moment in time, I think everybody is jumping the Gun, so to say. When you start listing many other cases here, Daktari, what are you trying to tell Kenyans? How are the issues you are bringing in here, about Kimunya, Saitoti, Wetangula, Ongeri, Kajwang, Kiraitu, Moi, Uhuru Kenyatta, etc related to the Case in question. You have also erroniously accused Uhuru Kenyatta of taking all the land without paying a dime.
That is a false accusation, as Uhuru never took anybody's land. His father did. Now do you really want us to believe what you are writing?
 
Doctor Abonyo, I am confused a little as to your understanding of the Law. Do you mean to tell this forum that due to the fact that all these other people you have mentioned, were implicated on other cases of corruption, then Ruto should not be tried for an alleged economic crime he is alleged to have committed?
 
If you, Dr. Abonyo, is trying to defeat the Judicial process by arguing like that, then why do you, at times, poke your nose on other matters touching on corruption in these forums? Further, Do you believe that there should be a an effective Judicial System of the Kenyan Government? If so why then would you belittle the efforts of some Judges when they follow the Law to bring cases to a Court process? Does it seem to you that Ruto is being brought through a Court process, by Malice of the judges. Or do you believe that this is the right channel to follow?
 
Would you rather Ruto proves that he is not guilty of any wrong doing so that this case is concluded once and for all so that there after Ruto himself can leave a free life, or would you rather the Judges "CORRUPTLY" dismiss this case.

Reason: He stole election in broad daylight/Anglo leasing protection. Githongo was in exile because he was afraid of Kibaki. Why is this case not in court. 96 million vs billions and lives lost. Which one is major?

Reason: Goldenberg: Billions lost
 
3. Ongeri
Reason: School fund: Millions lost
 
4. Kimunya
Reason: Grand regenecy: Millions stolen 
 
5. Kiraitu
Reason: Anglo leasing: Billions lost
 
6. Watengula
Reason: Japan Embassy

Surely, why are all these people not in court. Why only one man. This is discrimination and it is going to fail. I am glad Raila is quiete on this.
 
The law must apply to all people not the selected few who have fallen out with the boss of the day.

Ongeri was never indicted, he could still be! Ruto has been indicted so Kibaki
did the right thing. I would like to see the Goldenberg folks indicted as well. They are still sitting quitely in the cabinet! Saitoti, Murungi should follow suit. Wetangula, Mudavadi among others should be looked at too!

Good point but Ongeri did not have any case in Kenya Judicial Court. Ruto has a case in court. This guy needs to face the music. Wananchi are tired of selfish politician. There are so many people who have been convicted and thrown to prison just because they're small fish and the big fish with corruption history are still loaming free. Let the big fish set the example of being free corrupt. It's the high time to have clean elected representatives to run the country

Higher Education minister William Ruto has been suspended from Cabinet, just days after a constitutional court ruled he will face fraud charges.
"Following consultations with the Rt. Hon. Prime Minister, His Excellency the President has stood aside Hon. William S. Ruto, EGH, MP from Office of Minister with immediate effect pending conclusion of the Nairobi Chief Magistrates Case No. 973 of 2004 as allowed by the Nairobi High Court Suit No. 1192/2005 (0S)," said a statement from Kibaki's office
