Re: Bashir was a guest of Obama not Kenya

It is instructive to note, and I dont think anyone has mentioned this so far that at Uhuru park Museveni did not come close nor shake hands with Bashir. His body language even while in stride with Kimunya was very telling. Total no nonsense guy Yoweri is. He WOULD apprehend Bashir and he's ready to dig in and fight Shabaab.

Karegwa you hit the nail on the head and more so when it was hot. I personally don't think that Kenya is well placed to arrest El Bashir. Kenya is looking ahead and casting the net on the referendum that will separate North Sudan and South Sudan. With the separation Kenya has alot to gain especially economically. The best thing Kibaki has done is to just keep quiet and leave those holier than thou guys to talk just to embarass themselves.
The invitation had nothing to do with party politics. It had to do with the government that is shared on a 50/50 agreement by the coalition government of Kenya.

To me it looks like Kenya was playing a hook and bait game where El Bashir will think that East Africa is an open ground to show America that nothing will actually happen about the ICC call. With this arrangement El Bashir will travel to Tanzania and will not be arrested but once he steps in Kampala that will be the end of the game. M7 is a no nonsense guy who will do anything to clean his name about the political situation in some areas where El Bashir is thought to be the funding agent of murder and "genocide".

I remain to be corrected.

I agree with everyone that Bashir should have been arrested. For all that we have read, he deserves a crib in  the Hague.. Bashir however did not just appear from the blues. Whowever invited him must have assured him that he would not be arrested in Kenya. Arresting Bashir on the soil of Kenya would have serious ramifications from Islamic fundamentalists and Al Qaida brothers. By failing to arrest Bashir, Kenya was able to appease all those militants that would  want to attack Kenya. Bashir is an ideal friend to ensure there is peace in the region and isolate Islamic Militants in the region. Bashir is the last guy you want to antagonise and even United States is divided on how to deal with Bashir issue. On  a  posititive note, having Bashir in town was the best lesson for him  on how to deal with the Sudan Referendum due next  year. Sudan goes to referendum in January next year and Al Bashir has learnt through Kenya that the will of the people is stronger than Military force. He witnessed a sea of humanity at uhuru park with a resolve to forge the country forward. I aver that Bashir's visit was organised by United States for him to learn what it means to admit to the will of the people in the event the Southern Sudan decides to recede from the North. Obama was playing to the gallery and he  and RED BURGER know that too well . American oil interests in Southern Sudan are bigger than any skull digging of justice for the massacred  Darfurians.. This is not the time to antagonize Bashir. Obama is dying to make friends with Arabs and this time again he succeeded but left Kenya to carry the mess.  Bashir indeed was a guest of United States of America in Nairobi not Kenya.

No body wants to be at war with the neighbour except if it is too inevitable. However ,which war could be sparked had Bashir been excluded from the promulgation ceremony in Kenya? How was the regional peace at stake so as to invite an adversely indicted person to spoil our historic party? Doing what Kenya did to invite Bashir was not playing political neutrality but a diplomatic gaffe.Period.

The AU. Who wants to be at war with a neighbour?

By the way arresting Bashir would spark real war with Sudan, who wants that? Sent from my BlackBerry® smartphone from Zain Kenya

To begin with, Kikwete was not at the function, Bashir is not Mohamed but Omar. It is unfortunate that most Kenyans see thigs from a Western perspective to become the potential "western parrots". As intellectuals we have to analyse the Darfur case carefully and avoid falling into the quagmire. I certainly know that many of you will be furious but, let's get our facts right. The was between Bashir and the West is due to Oil. The Sudan oil was discovered by an American company and due to their exploitation tendecies Bashir gave the tender to a Chinese firm. As intellectuals, i ask guys to make thei own conclusions. Do we remember saddam we were told he has WMD - Weapons of Mass Destruction, but until he was nyogwaed by the Americans te WMD had not been discovered.

The Sudan leader was in Kenya today - one of the dignitaries to witness the promulgation of the new constitution. Meanwhile, Mohamed el Bashir is still a wanted man by the ICC for genocide in Darfur.

As signatories to the ICC Laws and given that our constitution (old and new) has included ratified international laws as part of our governing law,

(a) should we have invited el Bashir at all?
(b) while here, were we not under obligation to arrest him and hand him over to the Hague and
(c) what then is our foreign policy with regard to Darfur?

Anyone?
