I was shocked to see Jirongo vouching for the No Minister's inclusion into the committees. This is the same Jirongo who promised to leave the country once the constitution passes! What will he be doing in the committee with 'air ticket' in his pocket?

A person who makes these observations cannot in good conscience sit in the cabinet, to implement that which he does not believe in. If I was any of these guys, I wouldn't take oath and swear allegiance under and to the same document.  Unless you are arguing they were knowingly lying to and alarming the general public.
Civil Society and NGOs have done and continue to do a lot of work in resettling IDPs and harmonizing communities. I think your challenge David is misdirected, please point your guns to the Church maybe?
Lastly, to further your argument I'd like to ask when was the last time you saw the church have zeal in the education of our children, the clothing of the poor and naked, shelter for the homeless?  The zeal with which they contributed to the constitutional debate was out of character.  It begs the question, why?

What in the world are your problems guys; Lack of relevancy? Dissent is the hallmark of democracy and it is what defines democracy, where do you now get it that people should be punished and fired from office merely for dissenting? I am one of those opposed to the document along with the 2.7 Million other Kenyans who felt this thing needed tweaking, the principles have admitted as much and even promised changes after passage, these changes promised by the principles were the basis of opposition, so are you now telling us we have no legitimate concerns that must be addressed? Was this a mirage? Did the principles' acknowledgement and promises to fix this thing empty rhetoric? Further, a constitution is not discretionary, it is the law and I am yet to see anyone purposely frustrate the law and still keep his/her job. You cannot prejudge people's capacity to discharge their duties merely for dissenting and therefore preclude them from serving, our system of government is based on fairness and opportunity, failure to perform triggers remedial action including termination and if necessary, prosecution for abuse of office or dereliction of duty. Frankly, if you ask me, the two principles should be prosecuted for abuse of office because of the manner in which they blatantly abused and disregarded the law by co-opting the entire civil service to campaign and vote for the document in spite of clear explicit laws prohibiting the civil service from engaging is such political activities. They failed us; be that as it may, we have this new baby that need to be nurtured, nurturing the new constitution must also be void of vindictiveness you guys are espousing, there is nothing to be gained.

On an unrelated note; why aren't you guys who masquerade as "Civil Societies" and "Human Rights" bodies not so vocal about IDPs? Uh? Not as lucrative maybe? What could be nobler than demanding the settlement of every single IDP in Kenya? Why aren't you George Nyongesa demanding justice for the PEV victims? Isn't that a worthy cause you think? What should Ocampo do to those found most responsible, should Ocampo indict the principles? Ruto, Kihara, etc? You know it is coming; what are you civil societies doing to help the cause of IDPs and victims of violence?

Why should they resign. If anything, the new Constitution stands for freedom of opinion and expression. Lets be accomodative....

Statement demanding "No" campaign leaders to resign from Cabinet!

Following the passing of the new constitution into new law, there are certain realities that all Kenyans must remain alive to. The most fundamental of these is that we should not forget that it is people's pressure and not political goodwill from our politicians that achieved the ratification of  the new constitution at the Referendum. Therefore, for us to realize the change we long fought and even died for, we must remain vigilant, militant, steadfast and focused in the implementation of the new constitution. It is highly unlikely that the existing political class will be in any particular hurry to bring about radical changes provided in the new constitution since that threatens the fortunes they selfishly enjoy in current social order.

To speed us to the new order, we urge the President of the Republic of Kenya, as an urgent priority to adjourn the current parliamentary session and soon thereafter re-call the legislators to attend to the fresh business of implementing the new constitution, after they have sworn fresh oaths of office as provided for in the new constitution.

Even as we transition from the old order, we challenge the Cabinet Ministers and Assistant Ministers that were hostile to the adoption of the new constitution, to voluntarily resign from their Cabinet duties and responsibilities since the Cabinet is expected to play a pivotal role in leading the implementation of the new constitution. In addition, we challenge them, especially the likes of Hon. William Ruto, Hon. Samwel Poghisio, Hon. Naomi Shaban et al  that they should go a second mile in consistency with their referendum campaign speeches and refuse to take oath on the new constitution until and unless the alleged contentious issues that made new constitution a bad document are dealt with.  We demand this as a minimum since in the referendum campaigns they told us in rallies and through press statements and articles that they were strongly, genuinely and patriotically opposed to the new constitution because it was a dangerous document.

In the event that Mr. Ruto, Mr. Poghisio, Mr. Jirongo and Ms. Shaban decide against their pre-referendum wisdom, the big question they must answer to the 30% of electorate that they persuaded to support their call for defeating of the new constitution at referendum ballot is, how can you take an oath and promise to uphold, respect and defend a document that you labeled to be so evil? In the absence of their voluntary resignations, these MPs and Cabinet Ministers will have confirmed that their campaign rhetoric was nothing other than selfish, hypocritical and deceptive tirades to hoodwink Kenyans so as to protect their interests that were secure in the old constitutional dispensation.

Aware that statesmanship, honesty and personal integrity is in short supply among our political elite, especially the individuals we are challenging to voluntarily resign, we call upon President Mwai Kibaki and Premier Raila Odinga not to be arm twisted by political expediency but to immediately relieve Cabinet Ministers who opposed the new constitution of their duties and responsibilities as they are likely to misuse their strategic position to derail or sabotage the smooth implementation of the new constitution.

All Kenyans including Mr. President and Prime Minister should not lose sight of the fact that if Ruto et al had been successful  at the referendum contest they would have quickly demanded  the resignation of Mr. Mwai Kibaki and Mr. Raila Odinga to pave way for fresh general elections. So our call is that in the same political spirit that they would have driven such a campaign, they should be willing to do the same thing they would have demanded of the leadership and supporters of the new constitution. Technically speaking, the Yes win was a vote of no confidence in the leadership that led the No campaign.

In conclusion, we want to remind the political class that the new constitution signals the end of the "error" of backroom negotiations and horse trading for political expediency that was enabled by the old constitution. Under the new constitution, we are now in an era of conducting public affairs in an open, transparent and above board manner. Therefore, we shall not entertain any backroom negotiations on the new constitution without following to the letter, the law on amendments as provided for in the new constitution.  Kenyans in their numbers, 67%, did not pass the new constitution to amend it. If there is any politician, be it President Kibaki, Premier Raila or any other that promised to renegotiate any clause in the new constitution, it was simply acts of political expediency characteristic of the old order that we have jettisoned. We the people of Kenya who voted and passed to give ourselves a new constitution are not and should not be held responsible for fulfilling those shadowy promises.
