Re: Reforms;The Provincial Administration. (Attn.Maurice)


Dear friends,
 
Over time,questions have arose as to how the new devolution system will work and in particular what the will be on the provincial administration.
 
Under the office of the president ,in the old constitution,we had the office of the president,the Provincial Commissioners,the District Commissioners,Division Officers and the office of the Chief operating at the grassroot people where the real people of kenya exist with their chores.
 

Under the New Constitution,In the sixth Schedule,under article 262),part 4 on devolution government,its provided thus;-

'Within five years after the effective date,the national government shall restructure the system of administration commonly known as the provincial administration to accord with and respect the system of devolved government established under this constitution.'

I opine that the Districts will be disbanded as Counties will be the fulcrum for regional governance under Governors.The Government at the national and county levels will be distinct and interdependent ,conducting mutual relations on the basis of consultation and co-operation.

Here,the distribution of the national cake is received for the purpose of consumption than how it has been distributed from the centre depending on the political will which has seen skewed and/or imbalanced development.

A national cake ( percentage ) as enshrined in the constitution  will be dispatched to every county every financial year.

The governor will link the grassroots with the national office ( Office of the president ) ,otherwise with the DCs,governance will overlap.That is why its said that Restructuring will take place and have a two tier.
 
Among the objectives of devolved system of government is to give powers of self-governance to the people and enhance the participation of the people in the excercise of the powers of the state,and in making of decisions affecting them - thios will be at the ward level where the office of the chief will be structured to.

Provinces will only exist for geography and historical purposes.The offices of the chiefs ought to exist at the grassroots level to take care of local administration and any duty that may be assigned by an act of parliament.

An act of parliament will place the finer details of operationalization.

Evans,

In your opinion, do you think districts will be disbanded? I hope they are because otherwise they'll become an unnecessary layer of governance.

We do not want a situation such as TZ where 75 percent of revenues are used just to pay government staff.

The provincial administration will be re-structured. That includes phasing out some positions like PCs and Dcs.

Does anyone know how districts will fit into counties? Who will head the districts? I hope the idea of DCs will be abolished.
