The Constitutional Court today rules on the case of Okiya Omtata vs "The people of Kenya"
Today, August 2, 2010, at exactly 9am, three High Court judges shall majestically stride into the Interim Independent Constitutional Dispute Resolution Court room housed at Lenana Hall, KICC Nairobi to deliver a landmark ruling in what is now referred to as the matter of "Okiya Omtata vs The people of Kenya".
As a representative of the people of Kenya in the matter, I am both nervous and excited. On the one hand, my nervousness is informed by the insensitivity of our judicial system to public justice. On other hand, my excitement is informed by the mood of the nation that is heavily pregnant with anticipation of a new constitutional order such that the bench of judges would have to be legally insane to rule any other way than in the majority's interest.
Nevertheless, confident that I am on the side of the people, on the side of justice and on the side of fairness, I am making my way to the courts excited that today's ruling is a curtain raiser of the ruling of the people of Kenya on the proposed constitution to be delivered on August 4, 2010. I am excited and confident that no amount of propaganda, half truths and lies from the Mois, Rutos or Jirongos and no amount of mischievous court applications or bomb pastors shall stop us from giving ourselves a new constitution.
I want to urge all of us who can make it in our numbers to come to court this morning, to consider it a proactive exercise of protest against political conspiracies designed to detain us a moment, a day, a week, a month, a year or even a decade longer in a current state of corruption and impunity.
Above all, in the next 48 hours it must be all systems go in getting out the vote. Let us start knocking on the doors of our neighbours, sending those text messages, writing those emails and making those phone calls to our acquaintances, friends, relatives, peers and workmates to get out the YES vote.
See you in court and see you at the referendum ballot box!
