Re: [NVK-Mageuzi] RE: [NewVisionKenya] Re: Okiya and team loses

Dr. Obonyo,
Mosi mosi ndugu. There are very few people opposed to diasporans getting voting rights. I am also disappointed to see that we cannot vote tomorrow and so on that we are together 100%. Other issues raised by Omtatah and others are very genuine and important and that is why even your most ardent opponent, Migosi Sungu toed with the idea of multiple choices so that voters can vote for those issues. I think that was a very wise move and I believe even the 5% contentious issues need to be addressed. We only differed on the modalities of addressing the needs and felt that Kenya should not be held hostage by a few diaporans whose interests could not be catered for within that frame of time.

I dont think our voting would change the outcome. Since you are voting for NO, I would even advise you to praise the Lord that diasporans will not vote on August 4th. I have only heard of a very tiny minority among us opposing the document and so if you expect them to have swung the pendulum towards NO, then you are living in another planet. It is the YES side which got hurt but since the motive was to buy time so that the NO votes can increase through lies and propaganda, I am glad that your motion was shown the door.

On another note, it was a question of postponent and a possibility of YES losing and so the provision for dual citizenship going in smoke. I would rather not vote and get this than vote and lose it. You dont need a rocket scientist to see what is better. Everything from governance to rights of minorities is so good in the draft that, i was willing to lose one of my fingers to get the document passed.

I will let you know if I arrive in Tallahassee. I plan to bring Wams with me. She lived in Fort Walton Beach while I was at Pensacola. A lady I worked with at Pensacola now works at the State Hospital in Chattahoochee and she wants me to visit her. Since these Americans dont want us drag the whole clan with you and like privacy, Wams will spend at your house while I spend at my family's one bedroom house at Chattahoochee. She will be your guest but we will be meeting during the day at the State Capital, hoping that i wont be too exhausted for the meetings.

I would have said lots of things about NO but the campaigns are over and we must respect the laws and instutition. I only urge fellow netters to maintain peace tomorrow. Both Nos and Yes groups need a united country devoid conflicts.

I take this chance to thank all those netters who contributed to the lively debates. After tomorrow the fora will return to normal programes. May God bless our great country.

Take care.

My point is that there was no order on the diaspora case, there was a recomendation. I am happy with the recomendation because it edges us closer to a diaspora constituency. It is amazing that all you want to hear is something about the stoppage of the referendum. You are like a frog that believes that the pond he/she inhabits is the whole world. I attribute that to your walking while your eyes are closed. Take the veil out, you may be able to see more.

Abonyo,

I thought you rushed to court to seek audience there? Now you condemn the couts after they passed judgement? The fact remains the courts found no merit in stopping the referendum, anything else you say is hogwash.

How come you did not condemn the judges when they granted your matter as urgent the other day and agreed to hear it despite the fact that the IIEC and CoE wanted it thrown out?

Was it heard fully, YES, was merit found, NO. Period!!! Thrown out.

Your justification of mediocrity will never make it rocket science. Even in 2012 we may still have to fight for this to get it done. I am glad we were able to tell Kenyans that there are some people who still stand for a new fight. That new fight is that every Kenya has a right and that right must be respected and that the judiciary has atleast a chance to make some important decisions in our republic. We had to tell the powers to be that the rule of law is supreme and had it not been for a country overhwelmed by hero worship and blind following, the rule of law would have prevailed irrespective of the cost of carrying out the process. But we are still in the third world my friend. We are still struggling with simple things like understanding our rights and fighting for it no matter what. We are still struggling with tribalism, clanism and nepotism. We are a young democracy. Dont blame you. A donkey that is used to having a large luggage on its back never notices the difference.

This case of dispora voting was already being addressed by the Ministry for Justice even before the case, by and large, with dual citizenship, a lot was being considered in the draft KATIBA regarding the diaspora the reason the case was overtaken by events!!!

With the able IIEC and the way it is going electronic, even the case was unnecessary  and causing anxiety for no good reason because I am sure the IIEC was going to be up to task to ensure diaspora vote in future elections.

The rulling did not sight intent but time. It is as simple as saying that "Your case has been overtaken by events". Sounds very familier. I am glad that we atleast made it easier for diasporans to vote in the next general election. That is a big plus. Diaspora is now a constituency and will be a swing vote in 2012.

Daktari,

The case was wrongly timed with the historical constitutional moment and more intent on mischief rather than any tangible gains viz a viz the larger constitutional reforms; much intent on holing the whole country at ransom and the judged did the country proud by throwing it out as it deserved.

We are still in the era of impunity. They dragged it to make sure that it is overtaken by events.

Glory be to God for clearing all the huddles anti reform agents have kept putting on the reform path, inserting strange words into the draft, the lies, propaganda, misinformation, threat leaflets, bombing, political verbal threats, court cases, what else could they not have done??

The reform is trully unstoppable and it is an idea whose time has come.

Justice has been served and we can all troop to the ballots on 4th without any fear.

Let us serve our own style of justice to these anti-reformers and land grabbers on 4th August.

Let us vote YES na fujo.
